You are a qualified hypnotherapist working in the UK, Australia, Canada, Europe or elsewhere. Someone in the United States contacts you about online hypnotherapy.
Perhaps they want help with smoking, confidence, anxiety, a phobia or a persistent habit. You have the experience, the technology and an available appointment.
But can you legally work with them?
The short answer is: potentially, yes. A client’s American nationality does not, by itself, determine whether you need US professional authorisation. The important questions include where the client is physically located during the session, what services you actually provide, which professional-practice laws apply, and whether you meet their requirements or a valid exemption. For regulated healthcare, US government guidance emphasises checking state requirements and verifying the patient’s location.[telehealth.hhs]
There is no single nationwide hypnotherapy licence that answers those questions. Some states regulate hypnotists or hypnotherapists specifically. Others regulate the psychological, counselling or medical services for which hypnosis might be used.[hypnosis]
This guide explains what international hypnotherapists should investigate before accepting clients located in the United States. It examines selected state requirements, explains the limits of common assumptions, and provides a practical research checklist.
Quick answer
- Do not assume that you need a particular US credential simply because your client is American. For regulated healthcare, the client’s physical location and the applicable state requirements are central considerations.[telehealth.hhs]
- Washington and Connecticut have specific hypnotherapist or hypnotist registration requirements, subject to exemptions.[app.leg.wa][portal.ct]
- Florida expressly restricts hypnosis used for therapeutic purposes.[flsenate]
- California distinguishes certain vocational or avocational self-improvement activities from therapy for emotional or mental disorders.[california.public]
- Colorado’s former route for new unlicensed-psychotherapist registrations is closed, while Vermont maintains a roster for nonlicensed and noncertified psychotherapists.[dpo.colorado][legislature.vermont]
- Insurance cover and legal authorisation are separate questions. Check both territorial cover and the jurisdictions in which claims are covered.[apexinsurancebrokers.co]
Important: This article provides general professional information, not legal advice. It does not establish that any particular overseas practitioner may lawfully provide services in a US jurisdiction. Obtain appropriate legal or regulatory confirmation before relying on an exemption or accepting work where the position remains uncertain.

1. Why is hypnotherapy law in the USA so complicated?
One reason is that hypnosis is used in different contexts.
A performer might use hypnosis for entertainment. A coach might incorporate hypnotic techniques into performance training. A practitioner might use hypnosis to address symptoms associated with a psychological disorder or physical illness.
The techniques may overlap, but their legal classification may differ. Florida’s legislation specifically addresses therapeutic hypnosis, while California’s psychology legislation contains provisions concerning vocational and avocational self-improvement. Washington has a specific registration requirement for hypnotherapists.[app.leg.wa][flsenate][california.public]
The legal question is therefore not simply:
“Am I using hypnosis?”
It is also:
“What service am I providing, and which laws regulate that service?”
The distinction between hypnosis and psychological treatment
California provides a useful illustration.
Business and Professions Code §2908 contains provisions concerning people using hypnotic techniques for vocational or avocational self-improvement, provided they do not offer therapy for emotional or mental disorders. It also addresses hypnotic techniques used following specified professional referrals.[california.public]
This illustrates why the purpose and substance of the work matter. Helping someone rehearse a presentation may raise different questions from offering treatment for a mental-health disorder.
However, §2908 is a provision within California’s psychology legislation. It should not be read as a universal exemption from every other healthcare or professional-practice requirement.[california.public]
The same caution applies to labels. When assessing whether work falls within a regulated activity, investigate what you actually do and claim to provide, rather than relying on descriptions such as “coaching”, “confidence work” or “non-clinical hypnosis”.
2. Does working from outside the USA make a difference?
Yes, but you should not assume that being overseas removes US regulatory considerations.
Suppose you are in London and your client is in New York. You conduct the session online, your business is registered in the UK, and payment goes into a UK bank account.
Those facts do not establish that only UK requirements are relevant. For regulated healthcare, the US Department of Health and Human Services explains that cross-state practice depends on state rules and advises providers to verify the patient’s location before appointments.[telehealth.hhs]
However, that guidance does not itself determine the legal position of every overseas, non-medically licensed hypnotherapist. Whether your proposed service requires authorisation depends on the relevant legislation, the activity involved and any applicable exemption.
This article does not establish how each state applies its laws to a practitioner physically outside the United States.
What if the client is travelling?
A client who normally lives in California might join an appointment while visiting Florida.
Do not assume their usual address settles the question. Their location during the session is relevant to the regulatory assessment. HHS guidance specifically recommends verifying patient location before appointments.[telehealth.hhs]
Add this question to your pre-session procedure:
“Which state and country are you physically located in today?”
Where emergency arrangements depend on location, also establish enough information to identify where assistance would need to be sent.
3. Selected state requirements: a starting point, not a legal clearance
The table below highlights selected provisions relevant to hypnosis or psychotherapy.
It is not a comprehensive survey of all 50 states. Inclusion does not mean that overseas practice is prohibited, and omission does not mean that a state is unrestricted.
| State | Identified regulatory issue | What to investigate |
|---|---|---|
| California | Express hypnosis-related provisions within psychology legislation | Whether the actual work falls within §2908 and whether other laws apply. [california.public] |
| Colorado | New unlicensed-psychotherapist registrations are no longer accepted | Whether the proposed services constitute psychotherapy and what lawful route, if any, is available. [dpo.colorado] |
| Connecticut | Hypnotist registration | Whether registration is required for overseas online delivery and whether an exemption applies. [portal.ct] |
| Florida | Restrictions on therapeutic hypnosis | Whether the proposed work satisfies Chapter 485 and any other relevant professional-practice requirements. [flsenate] |
| Indiana | Former hypnosis certification legislation repealed in 2010 | Current professional-practice boundaries, rather than the former certification scheme. [law.cornell] |
| Vermont | Roster for nonlicensed and noncertified psychotherapists | Whether the proposed work meets the statutory definition of psychotherapy and triggers roster requirements. [legislature.vermont] |
| Washington | Hypnotherapist registration | Whether registration or an exemption applies to the proposed overseas online practice. [app.leg.wa] |
What about the other states?
For each additional jurisdiction, investigate:
- Hypnosis-specific legislation or registration.
- Definitions of psychology, psychotherapy, counselling and medical practice.
- Protected titles and advertising restrictions.
- Exemptions and their conditions.
- Remote-practice and nonresident requirements.
- Mandatory disclosures, consent and recordkeeping requirements.
Do not treat an unsuccessful search for the word “hypnotherapy” as legal clearance. The activity may need to be assessed under a broader professional-practice framework.
The useful question is:
“May I lawfully provide this particular service to a client physically located in your state, while I am practising from another country?”
4. Seven US states that deserve particular attention
Washington: hypnotherapist registration
Washington has a clear hypnosis-specific registration provision.
Under RCW 18.19.035, a person may not practise hypnotherapy for a fee, or as part of employment with a state agency, without registration unless an exemption applies. The Department of Health administers hypnotherapist registration.[app.leg.wa][doh.wa]
Registration as a hypnotherapist should not be confused with qualification or licensure in a different profession, such as psychology.
For overseas practitioners, this article does not establish whether the registration requirement applies to the proposed remote service or whether the practitioner is eligible to register.
Useful references:
Our advice: Seek written clarification before accepting a paying client physically located in Washington. Describe the actual services, not just your professional title.
Connecticut: hypnotist registration
Connecticut requires people practising hypnosis or holding themselves out as hypnotists in the state to register with the Department of Consumer Protection, subject to exemptions. The published application fee is $100, with a $100 annual renewal fee. Registrations expire annually on October 31.[portal.ct]
The exemptions include specified professionals licensed by Connecticut. An overseas hypnotherapy qualification should not be assumed to satisfy those exemptions.[portal.ct]
Useful references:
- Connecticut General Statutes, Chapter 400m
- Connecticut Department of Consumer Protection: Hypnotist Registration
Our advice: Ask whether your proposed overseas online service requires registration and whether nonresident applicants are eligible.
Florida: therapeutic hypnosis is restricted
Florida deserves particular care.
Florida Statutes §§485.003–485.004 restrict hypnosis for therapeutic purposes to specified practitioners licensed under Florida law, acting within their professional scope, or qualified people working under such a practitioner’s supervision, direction, prescription and responsibility.[flsenate]
The definition of a qualified person refers to both professional training and experience. The statute’s definition of therapeutic purposes is broad, covering treatment of a human ill, disease or injury, “or any other therapeutic purpose”.[flsenate]
An overseas diploma, association membership or ordinary referral letter should not be assumed to satisfy those requirements.
Useful reference:
Our advice: Do not accept therapeutic cases involving clients physically in Florida without establishing a lawful basis for the work. Obtain legal advice where the application of the provisions is uncertain.
California: self-improvement, referrals and professional representations
California Business and Professions Code §2908 addresses people using hypnotic techniques:
- By referral from persons licensed to practise medicine, dentistry or psychology.
- For vocational or avocational self-improvement, where they do not offer therapy for emotional or mental disorders.[california.public]
The provision also restricts specified psychology-related titles and representations. It is not blanket permission to offer every service described as hypnotherapy.[california.public]
Useful reference:
Our advice: Define the actual service, examine the precise statutory wording, and investigate any other requirements relevant to the work. Do not assume that a referral from any professional creates permission to practise.
Colorado: do not rely on outdated registration advice
Colorado no longer accepts new registrations through its unlicensed-psychotherapist database. Qualifying practitioners registered before July 14, 2020 may continue through the renewal route, subject to the requirements.[dpo.colorado][law.justia]
Consequently, older articles suggesting that a hypnotherapist can simply join the database may be misleading.
Colorado also has a complementary and alternative healthcare framework under §6-1-724. That framework includes conditions and disclosures and does not authorise practising psychotherapy through that route. It should not be treated as a general hypnotherapy exemption.[colorado.public]
Useful references:
Our advice: Establish whether your proposed activity constitutes psychotherapy and what current authorisation requirements apply.
Vermont: a roster for nonlicensed psychotherapists
Vermont maintains a statutory roster for nonlicensed and noncertified psychotherapists. Its legislation defines psychotherapy by reference to paid services intended to alleviate mental disorders and establishes requirements for people within that framework.[legislature.vermont]
“Nonlicensed” therefore should not be read as “unregulated”.
Useful reference:
Our advice: Determine whether your work falls within the statutory definition and ask how the requirements apply to overseas online delivery.
Indiana: former certification requirements were repealed
Indiana previously had specific hypnotist certification legislation. That legislation was repealed effective July 1, 2010.[law.cornell]
The frequently cited Connecticut comparative report was published in January 2010, before the repeal. Its account of Indiana’s certification requirement is therefore historical, not a current requirement.[law.cornell][cga.ct]
The repeal does not, by itself, establish that every proposed psychological or health-related service is unrestricted.
Our advice: Investigate current professional-practice boundaries rather than relying on pre-repeal certification summaries.
5. Does the reason for hypnotherapy make a difference?
Yes. California’s distinction between certain self-improvement activities and therapy for emotional or mental disorders illustrates why the purpose of the work matters. Florida’s broad therapeutic-hypnosis provisions illustrate why health-related work requires particular care.[flsenate][california.public]
Consider three examples.
A professional speaker seeking confidence
A client in California wants help preparing for presentations. You offer imaginative rehearsal, self-hypnosis education and performance practice.
This may be consistent with vocational self-improvement, depending on the actual services and representations involved. It is not an automatic legal clearance.[california.public]
A client seeking treatment for panic disorder
A client asks you to treat panic disorder. Your proposed service is expressly intended to address a mental-health condition.
Do not assume that the self-improvement wording in California’s legislation covers that work. Investigate the applicable treatment restrictions and any lawful referral or authorisation route.[california.public]
A client seeking relief from chronic pain
A client in Florida requests hypnosis for chronic pain.
Florida’s provisions concerning therapeutic hypnosis are directly relevant to investigating that service. An overseas qualification alone should not be treated as establishing compliance.[flsenate]
Questions to ask about common presenting issues
Rather than assigning every presenting issue a universal legal category, use it to guide your investigation:
| Proposed service | Questions to investigate |
|---|---|
| Confidence or performance | Is there an applicable self-improvement provision, and does the actual work fit it? |
| Self-hypnosis education | Is the service genuinely educational, or does it include treatment? |
| Smoking cessation or habit change | How do the relevant laws classify the service and its advertised claims? |
| Stress, anxiety or phobias | Does the work constitute regulated psychological treatment or counselling? |
| Depression, PTSD or trauma-related difficulties | What mental-health practice authorisation is required? |
| IBS, chronic pain or other physical symptoms | What medical-treatment, therapeutic-hypnosis or referral requirements apply? |
These are research questions, not declarations that a category is lawful or unlawful.
6. Will my international hypnotherapy qualification be recognised?
Do not assume that an overseas diploma creates US legal authorisation.
The state frameworks discussed above impose their own requirements. Connecticut’s exemptions, for example, refer to specified Connecticut-licensed professionals, while Florida’s definition concerns specified practitioners licensed under Florida law.[portal.ct][flsenate]
Keep three questions separate:
- Am I competent to provide the service?
- Is the work appropriate to my training and professional role?
- Am I legally authorised to provide it in the relevant circumstances?
Professional training, association membership and supervision can support responsible practice. They should not be treated as substitutes for any statutory registration, licence or exemption that applies.
7. Insurance, privacy and emergency arrangements
Professional indemnity and treatment-liability insurance
Before accepting the work, obtain written confirmation that your policy covers the proposed services.
Territorial limits and jurisdictional limits are different. A policy described as “worldwide” may still exclude claims brought in US or Canadian courts or under those countries’ laws.[apexinsurancebrokers.co]
Ask your insurer:
- Does the policy cover online services delivered from my country to clients physically in the USA?
- Does it cover the particular states involved?
- Are proceedings in US courts covered?
- Are claims under US law covered?
- Does the policy cover my actual services, descriptions and treatment claims?
- Are there relevant exclusions or conditions?
Whether insurance is legally mandatory is a separate, jurisdiction-specific question. Insurance should not be treated as proof of legal permission to practise.
UK GDPR and health information
For a UK-established practice, UK GDPR generally applies to relevant client-data processing, including work involving clients abroad.
Where records contain health information, identify both an Article 6 lawful basis and an Article 9 condition for processing special-category data. Additional Data Protection Act 2018 requirements may apply. Do not assume that calling your work healthcare automatically establishes the appropriate condition.[ico.org][ico.org]
International data transfers
Using overseas software providers, cloud storage or other organisations may raise international-transfer questions.
However, communicating with an individual client abroad does not automatically make every exchange a restricted transfer. The ICO’s assessment includes whether information is being made available to a separate organisation outside the UK.[ico.org]
Useful reference:
This subsection addresses UK requirements. Practitioners based elsewhere should separately investigate the privacy and data-transfer rules applicable to their practice.
Does HIPAA apply?
Not automatically.
HIPAA applies to covered entities and business associates. The healthcare-provider definition includes requirements concerning electronic transactions for which HHS has adopted standards. Having an American client, using video appointments or keeping electronic notes does not, by itself, establish HIPAA coverage.[hhs]
Other privacy laws or confidentiality requirements may still need investigation.
Emergency arrangements
As a practical safeguard, establish procedures before beginning international work:
- Confirm the client’s location.
- Obtain appropriate emergency contact details.
- Identify how local assistance could be contacted.
- Explain relevant confidentiality limits.
- Plan for disconnection during a crisis.
- Identify suitable local referral options.
Include these arrangements in your assessment of whether remote work is appropriate for the particular client.
8. Seven steps before accepting a US client
Step 1: Establish both locations
Record where you will practise and where the client will physically receive the session. Confirm the client’s location again at each appointment. HHS recommends location verification before telehealth appointments.[telehealth.hhs]
Step 2: Define the actual service
Write down what you intend to do, why the client is seeking help, and what outcomes you propose.
Do not rely solely on a broad title such as “hypnotherapy” or “coaching”.
Step 3: Research the relevant requirements
Examine hypnosis-specific rules and broader professional-practice legislation. Use current official legislation and regulator guidance wherever possible.
Step 4: Resolve uncertainty
Ask the relevant regulator about overseas delivery, authorisation and exemptions. Where the response does not resolve the issue, obtain advice from a lawyer qualified in the relevant jurisdiction.
Step 5: Confirm insurance
Obtain written confirmation of cover for the services, client location and relevant claims jurisdiction.[apexinsurancebrokers.co]
Step 6: Prepare the documentation
Check informed consent, professional disclosures, privacy information, recordkeeping and emergency arrangements against the requirements relevant to your work.
Step 7: Make an acceptance or referral decision
If you cannot establish an appropriate basis for proceeding, do not treat uncertainty as permission. Resolve it before accepting the work or refer the client elsewhere.
A useful email to a state regulator
Subject: Overseas practitioner providing online hypnosis services to a client in [State]
Dear Licensing Team,
I am a hypnotherapist based in [Country], where I operate my practice. I would remain physically in [Country] while providing online sessions to a client physically located in [State].
My qualifications and professional status are [details].
The proposed services are [describe the activities, presenting issue and intended outcomes accurately]. My advertising and client documentation describe the service as [description].
Please could you clarify:
- Whether these services require registration, licensure or another authorisation.

9. Frequently asked questions
Can a UK hypnotherapist work with clients in the USA?
Potentially. Do not assume either blanket permission or blanket prohibition. Investigate the client’s physical location, the actual services and the applicable state requirements.[telehealth.hhs]
Do I need a US hypnotherapy licence?
There is no single nationwide answer. Washington and Connecticut have specific registration frameworks; other states’ requirements may turn on the services being provided.[hypnosis][app.leg.wa][portal.ct]
Can I offer confidence or performance work without a healthcare licence?
California contains a relevant self-improvement provision, but it has limits and should not be applied as a nationwide exemption.[california.public]
Is smoking cessation automatically exempt?
Do not assume so. Describe the actual service and claims when obtaining state-specific clarification.
Does a doctor’s referral authorise the work?
Not automatically. California specifies particular referral categories, while Florida requires more than an ordinary referral: its legislation refers to supervision, direction, prescription and responsibility.[flsenate][california.public]
Can I change my title to “hypnosis coach”?
Do not rely on a title change. Check how the relevant law defines the activity and which professional representations it restricts. California’s provision, for example, expressly addresses certain titles and representations.[california.public]
Does it matter that the client contacted me first?
Do not treat client initiation as an exemption. The registration and therapeutic-hypnosis provisions discussed here do not make permission depend simply on who made first contact.[app.leg.wa][portal.ct][flsenate]
Can insurance make an otherwise prohibited service lawful?
No policy should be treated as professional authorisation. Check legal requirements and policy cover separately.
Does HIPAA automatically apply?
No. Its application depends on covered-entity or business-associate status, not merely on the client being American.[hhs]
Can I rely on an association’s state-law summary?
Use it as a research aid, not legal clearance. Indiana demonstrates the risk of outdated summaries: its former certification legislation was repealed after the widely cited January 2010 comparative report.[law.cornell][cga.ct]
10. Official legislation and useful resources
Start with the relevant primary legislation and regulator:
- HHS: Licensing Across State Lines
- Washington: Hypnotherapist Registration Law
- Washington Department of Health: Hypnotherapist
- Connecticut: Chapter 400m
- Connecticut: Hypnotist Registration
- Florida: Chapter 485
- California: Business and Professions Code §2908
- Colorado: Unlicensed Psychotherapy
- Colorado: Mental Health Laws
- Vermont: Nonlicensed and Noncertified Psychotherapists
- HHS: HIPAA Covered Entities and Business Associates
- ICO: Special-Category Data
- ICO: International Transfers
The American Hypnosis Association’s state-law resource can help identify issues for investigation, but verify its summaries against current legislation and regulator guidance.
The Connecticut General Assembly’s 2010 comparative report is historical research, not a current statement of every state’s law.
11. Professional hypnotherapy training is more than learning techniques
Learning hypnotic techniques is one part of professional development. Learning how to assess a request, recognise your limits, seek clarification and make a responsible referral decision deserves attention too.
At Jacquin Hypnosis Academy, our emphasis includes practical learning and opportunities to practise with peers. Professional development should help practitioners think carefully about how they work, not simply add more techniques to their repertoire.[jacquinhypnosisacademy]
Whatever training you undertake, keep competence, legal permission and insurance as separate questions. A training certificate should never be presented as an answer to all three.
Explore the training and practice resources available through Jacquin Hypnosis Academy.
Final thoughts: can you work legally with American clients?
The responsible approach is not to search for a list of supposedly unrestricted states. It is to investigate the proposed service in its actual circumstances.
Before beginning, establish:
- Where you and the client will physically be.
- What you will actually provide and claim to provide.
- Which authorisation requirements or exemptions apply.
- Whether your insurance and professional arrangements are suitable.
Where those questions remain unresolved, obtain appropriate advice before accepting the work.
