These Terms of Use (“Terms”) govern your access to and use of the online services provided by:

These Terms apply to:

  • The Jacquin Hypnosis Academy mobile application (the “App”)

  • All associated online courses, memberships, communities, events, and digital content
    (collectively, the “Services”).

By using the Services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, you must not use the Services.

2. Eligibility & Account Registration

To use our paid Services you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction).

  • Have the legal capacity to enter into a binding agreement.

  • Provide accurate registration details and keep them up to date.

You are responsible for:

  • Maintaining the confidentiality of your login details.

  • All activity under your account unless you notify us of suspected misuse.

We may suspend or terminate access if we reasonably believe there is misuse, fraud, or a breach of these Terms.

3. Scope of Services & App Relationship

The App is an extension of our online training platform hosted via Kajabi.
Access to content in the App is determined by your active access and offers in your Jacquin Hypnosis Academy account.

If you lose access to a course or membership on the website (e.g. subscription cancellation), your access to that content in the App will also end.

Some purchases made via Apple App Store or Google Play are additionally governed by those platforms’ own terms and billing rules.

4. Intellectual Property & Licence

All content made available through the Services (“Content”) is owned by or licensed to UKHTC Ltd. This includes:

  • Videos, audio, scripts, written materials, workbooks, downloads

  • Logos, branding, graphics, images, and page layouts

  • Course structures, methods, and training frameworks

Subject to your compliance with these Terms and any applicable Offer or subscription:

  • We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Content for your personal educational use (or legitimate professional development) only.

You must not:

  • Share, sell, resell, or publicly distribute our Content

  • Record or upload our members-only content elsewhere

  • Remove copyright or proprietary notices

  • Use our trademarks, logos, or brand elements without written permission

5. Prohibited Use

You agree not to use the Services to:

  • Violate any law or regulation

  • Harass, abuse, or harm others

  • Share your login with others or provide unauthorised access

We may remove content, suspend accounts, or restrict access where we reasonably believe these rules are breached.

6. Purchases, Subscriptions & Renewals

Purchases may include:

  • One-time access to digital courses

  • Memberships and subscriptions (e.g. JHA Online)

  • Live trainings, workshops, and events

When you purchase:

  • You agree to the price and terms displayed at checkout.

  • Subscriptions auto-renew (monthly or annually) until cancelled.

  • You are responsible for managing your subscription and payment method.

For in-app purchases via Apple or Google:

  • The relevant app store manages billing and, in some cases, cancellations/refunds.

  • You must follow their instructions to manage or cancel.

7. Refunds & Cancellations

We aim to be fair and transparent. Unless otherwise stated at checkout:

Digital Products

  • 7-day money-back guarantee from the date of purchase.

  • Refunds cover the product fee only (excluding FX differences charged by your bank).

Memberships & Subscriptions

  • Subscriptions renew automatically until you cancel.

  • You may cancel at any time to stop future renewals.

  • Initial 7-day refund period from first purchase. After this, prior charges are non-refundable.

Live Events & Trainings

  • Refunds or transfer options are subject to the specific terms stated for each event (such as notice periods and admin fees).

General Notes

  • Excessive or repeat refund requests may be declined.

  • Refunds are normally returned via the original payment method.

  • For app-store purchases, refunds may need to be requested via Apple/Google directly.

8. Health, Wellbeing & Hypnosis Disclaimer

Our Services provide hypnosis, self-hypnosis, coaching, and related educational content.

You acknowledge and agree that:

  1. Our content is for educational and informational purposes only.

    • It does not constitute medical, psychological, psychiatric, or other professional healthcare advice, diagnosis, or treatment.

  2. Safety Requirements:

    • Do not use hypnosis, deep relaxation, or guided audio/video content while driving, operating machinery, or in any situation requiring your full attention.

    • Ensure you are in a safe, comfortable environment before using such content.

  3. Contraindications:

    • If you are pregnant, under psychiatric care, have epilepsy, a history of psychosis, or any serious mental health or neurological condition, you should consult a qualified healthcare professional before using hypnotic or deep-relaxation content.

    • If at any time you feel discomfort, distress, or adverse effects, stop using the content and seek professional advice.

  4. You are solely responsible for your own physical, emotional, and mental wellbeing when using our materials.

By using the Services, you agree not to hold UKHTC Ltd, its directors, trainers, or team members liable for any adverse effects allegedly arising from the appropriate use or misuse of hypnosis-related content.

9. No Guarantees (Education & Outcomes)

We do not guarantee:

  • Specific personal, therapeutic, or professional outcomes

  • That you will gain clients, income, or business success from completing our trainings

  • That techniques taught will produce particular results in every context or person

Your results depend on your own skills, application, ethics, and circumstances.
You remain fully responsible for how you apply what you learn.

10. Community & User Content

If you participate in forums, communities, chats, or live sessions:

  • You are responsible for what you post or say.

  • Do not share private client data or confidential information.

  • Do not post promotional spam, abusive content, or anything unlawful.

We may moderate, edit, or remove content and may suspend accounts that breach these Terms.

By posting content, you grant us a non-exclusive licence to display such content within our Services for community and educational purposes.

11. Third-Party Services & Links

Our Services may link to or integrate with third-party services, including:

  • Kajabi (hosting and learning platform)

  • Stripe, PayPal (payments)

  • Zoom or similar (live sessions)

  • Email, analytics, and app store services

We are not responsible for:

  • the content, policies, or practices of third-party sites or platforms; or

  • any technical or service issues caused by third parties.

Your use of third-party services is governed by their own terms and policies.

12. Availability, Updates & Changes to the Services

We aim to provide reliable access but:

  • We do not guarantee uninterrupted or error-free operation.

  • We may update, modify, or remove content, features, or products at any time.

  • We may release updates to the App that you may need to install to continue using it.

We are not liable for unavailability due to maintenance, technical issues, or events beyond our control.

13. Limitation of Liability

To the fullest extent permitted by law:

  • The Services and all Content are provided “as is” and “as available” without warranties of any kind, express or implied.

  • We do not warrant that:

    • the Services will be uninterrupted or error-free;

    • defects will be corrected;

    • the Services are free from viruses or harmful components;

    • any particular result will be achieved.

UKHTC Ltd, its directors, officers, employees, and agents shall not be liable for:

  • any indirect, consequential, incidental, special, or punitive damages;

  • loss of profits, revenue, data, business, or goodwill;

  • claims arising from:

    • your use or inability to use the Services;

    • your application of techniques taught;

    • third-party services or failures.

Our total aggregate liability for any claim arising from or related to the Services shall not exceed the total fees you paid to us for the specific product or service in the three (3) months preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes liability where it cannot be limited by law, including for death or personal injury caused by negligence or for fraud.

14. Indemnity

You agree to indemnify and hold harmless UKHTC Ltd, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of:

  • your breach of these Terms;

  • your misuse of the Services or Content;

  • your violation of any law or third-party rights.

15. Governing Law & Jurisdiction

These Terms and any dispute or claim arising from them (including non-contractual disputes) are governed by the laws of England and Wales.

You and we agree that the courts of England and Wales shall have exclusive jurisdiction, except where applicable consumer law allows you to bring claims in your local jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time.

  • The “Last updated” date at the top will reflect the latest version.

  • Material changes may also be notified via email, website notice, or in-app message.

Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
